JUICY VS. JUUCY – BBK FILES TRADEMARK INFRINGEMENT LAWSUIT

On February 2, 2022, BBK Tobacco & Foods (BBK) filed a lawsuit against BluumLab and Juucy, alleging trademark infringement, unfair competition, false designation of origin, and false advertising under the Lanham Act, 15 U.S.C., sections 1114 and 1125(a) and the common laws of trademark infringement.

BBK has a line of tobacco-related products with the name “JUICY,” including flavored cigars, cigar wraps, and natural liquid products used to flavor tobacco, e-cigarettes, cigars, etc. BBK is alleging that BBK has been using “JUICY” on its tobacco-related product and has been advertising under this name since 2001.

In its complaint two weeks ago, BBK is now alleging that sometime in 2020, BluumLab and Juucy have been selling smoking and tobacco-related product using the name “JUUCY.” BBK is alleging that the use of the word “JUUCY,” same pronunciation as “JUICY” is intended to cause consumer confusion with “JUICY” products. The complaint explains that the word “JUUCY” is written in italics on the products and advertising materials, stating that it looks as though it is pronounced the same way as “JUICY.”

What BBK wants now is for the U.S. District Court to order BluumLab and Juucy to stop the use, advertisement and selling of smoking related products with the word “JUUCY,” and also an order for the destruction of said products.
